You’re at Happy Hour. You had a long day, and you’re unwinding with a couple of co-workers. Happy Hour ends, and you’re contemplating driving home. You think, “I feel fine – had some food and it’s only a 10-minute drive”.

The next 10 minutes changes your life.

Now you’re on the side of the highway, face illuminated by red and blue flashing lights – thinking to yourself, “how did I get here?”

Most DUIs don’t play out as you’d typically expect. It’s not always the highly intoxicated man stumbling out of the bar and fumbling with his keys to start the engine. Yes, that happens. But, there are other DUI situations.

You are not required to take the various roadside tests.

There are a variety of tests an officer may ask you to complete: horizontal gaze nystagmus test, one-leg stand test, and the walk-and-turn test. What many people don’t know is that you don’t have to take these tests!

You are not required to take the breathalyzer on the scene.

The officer may ask you to take a PBT (preliminary breath test) on the side of the road. You don’t have to take this test! If the officer transports you to a jail or station and asks you to take a blood, breath, or urine test, immediately contact your criminal defense attorney.

You have the right to speak to an attorney before proceeding with any of the above tests.
